These Website “Terms and Conditions  (T&Cs) apply to your access and use of www.progteam.com, including all software, data, reports, text, images, sounds, video, and content made available through any portion of the Site.
Content includes all such elements as a whole, as well as individual elements and portions thereof.

Acceptance of Terms

Progteam permits you to access and use the Site and Content, subject to these T&Cs.
By by accessing or using any portion of the Site, you acknowledge that you have read, understood, and agree to be bound by these T&Cs.
If you are entering into these T&Cs on behalf of a company or other legal entity, you must have the legal authority to contractually bind such User Entity to these T&Cs, in which case the terms will refer to such User Entity.
If you lack such legal authority to contractually bind or you do not agree with these T&Cs, you must not accept these T&Cs or access or use the site or content.

– Progteam reserves the right, at its sole discretion, to change or modify portions of these T&Cs at any time.
– Porgteam will post the changes to these T&Cs on the Site and will indicate at the top of this page the date these terms were last revised.
– It is your responsibility to check the T&Cs periodically for changes.
– Your continued use of the Site and Content after the date any such changes become effective constitutes your acceptance of the new or revised T&Cs.

Access & Use

Authorization to Access and Use Site and Content. Progteam.com provides services to Users. The term “Freelance” is used in this Agreement to represent service providers (Service Vendors) with specific skills who are looking for assignments and carry out the projects published by the Project Holders.

1. Progteam.com facilitates contact between Users by offering a system for publishing projects and offers.
   We do not control the exchanges taking place between Users and Freelancers.
   Consequently, we do not define and we are not responsible for the price, the quality, the confidentiality clauses, the transfer of intellectual property, the conformity or legality of the tenders filed, the ability of Users to provide calls of tenders, or the ability of Freelancers to respond to and carry out these calls for tenders.
   We cannot and do not control Users’ ability to make payment.
   We are not responsible for transactions and/or contacts, or the results of these transactions and/or contacts made between Registered Users without going through the Progteam.com site.
   It is strictly forbidden to publish contact information in the description of a project.
2. Progteam.com is not a payment intermediary between the parties. Once the parties have been put in touch, it is up to them to conduct their business directly and with full responsibility.
   Progteam.com cannot be held responsible for the behavior or failure of either party during their business relationship.
3. You are solely responsible for all data, information and other content, that you upload, post, or otherwise provide or store in connection with or relating to the Site.
4. Progteam.com and its licensors each own and retain their respective rights to all logos, company names, brands, trademarks, copyrights, trade secrets, know-how, patents and patent applications that are used or incorporated or otherwise related to the Site and Content.
5. In the event of a dispute with the other party, arbitration may be carried out automatically in favor of the User who has provided these elements. Users who do not correctly fill in these elements may be excluded from the Progteam.com site.
6. In the event of a dispute, the Project Owner and the service provider undertake to continue their exchanges and to negotiate between them by all possible legal means to find an amicable solution to their dispute. They undertake to find a solution for the realization of the work, the delivery, the payment and the evaluation of the other party. If no amicable agreement has been reached within 30 calendar days after a problem has been reported by the project leader or the Freelancer, Progteam.com can become the arbiter of a dispute between the project leader and the Independent. Dispute resolution will include the original RFP, Independent RFP response, amendments, or related communications that occurred through the Website. If one of the 2 parties is not available to respond to the other or to Progteam, it must imperatively indicate this as soon as it becomes aware of it and at the latest 30 days before it is not available in order to that if a dispute arises, she can offer solutions before she is no longer available.

Intellectual Property Rights

The Website and all intellectual property rights related to this Website, including but not limited to copyright, trademarks, notices left by Registered Users, belong to us.
You are not authorized to reproduce, reverse engineer, decompile, disassemble, modify or create derivative works with respect to this Website and intellectual property.
Some of the Content may be under license control belonging to third parties.
All this content therefore belongs to these third parties.
Progteam reserves the right to delete or suspend the account of members whose behavior does not comply with the conditions of service, whose guarantees that they are working well in accordance with the law are not sufficient, or for any other reason. in particular: does not wish to pay its commissions, abusive or rude, bad faith, questionable behavior, etc.
Progteam reserves the right to publish, as a customer reference, the name of companies using its services.
By using our services, you therefore tacitly accept that Progteam may refer to the name of your company.

Limited liability

Exclusion of Damages and Limitation of Liability: We are not liable for any damages of any kind, direct or indirect, special, punitive or consequential, resulting from access to this Site or its use, or from any information contained on this Site. Site. All kinds of damages are thus excluded, including loss of profits, whether they relate to the parties or not, of contractual or extra-contractual origin (including in the event of negligence or fraud), or whether they result from liability for a service, even if We have been advised of the possibility of such damage.

Our contracts with our suppliers, in particular that of our host, imply that it may at any time carry out emergency or planned maintenance. • publicly performing and/or showing any Website material;
• using this Website in any way that is or may be damaging to this Website;
• using this Website in any way that impacts user access to this Website;
• using this Website contrary to applicable laws and regulations, or in any way may cause harm to the Website, or to any person or business entity;
• engaging in any data mining, data harvesting, data extracting, or any other similar activity in relation to this Website;
• using this Website to engage in any advertising or marketing.

Certain areas of this Website are restricted from being access by you and Company Name may further restrict access by you to any areas of this Website, at any time, in absolute discretion. Any user ID and password you may have for this Website are confidential and you must maintain confidentiality as well.
